Back pain can be disabling.

The causes of back pain can vary. Back pain can be the result of degenerative arthritis caused by an aging back, a herniated or ruptured disc, scoliosis, stenosis, osteoporosis, or nerve damage.

Back pain can also be caused by specific conditions such as ankylosing spondylitis. This is a type of arthritis where the bones in the spine grow or fuse together. This condition can become disabling due to pain and immobility over time.

You can qualify for disability on the basis of your back pain in one of two ways:
  1. First, your back arthritis may be so severe that it meets the Social Security Administration’s Listing of Impairments for back pain. In order to qualify for disability benefits under the Listing of Impairments for back arthritis there must be evidence of the following: nerve damage, limited motion of the back, and motor loss with sensory or reflex loss in your legs. These are specific medical findings, which is why it is important to hire an experienced lawyer who knows what to be looking for when reviewing your case.

  2. Second, you may qualify for disability benefits due to your back pain if it prevents you from working. If you are under 50 years old, you must prove that your back pain prevents you from performing a job requiring you to sit most of the day and to lift up to 10 pounds. There are special rules for those age 50 and age 55.
